LOCAL OFFICERS AND SERVANTS (DUBLIN) ACT, 1941.


AN ACT TO PRESERVE THE CONTINUITY OF SERVICE OF OFFICERS AND SERVANTS OF THE RIGHT HONOURABLE THE LORD MAYOR, ALDERMEN AND BURGESSES OF DUBLIN NOTWITHSTANDING CERTAIN ABSENCES FROM DUTY. [29th July, 1941.]

BE IT ENACTED BY THE OIREACHTAS AS FOLLOWS:—

Definitions.

1. —In this Act—

the expression “the corporation” means the Right Honourable the Lord Mayor, Aldermen and Burgesses of Dublin; the expression “period in respect of which this Act applies” means any period beginning on or after the 29th day of February, 1940, and ending before or on the 20th day of March, 1940;

the expression “the pension enactments” means, in relation to an officer or servant of the corporation, the enactments governing the grant to him on ceasing to hold office or to be employed of an allowance for life or a gratuity.

Preservation of continuity of service.

2. —Where an officer or servant of the corporation was absent from duty during any period in respect of which this Act applies and the period of absence would, but for this section, be regarded for the purposes of the pension enactments as breaking the continuity of his service with the corporation, the following provisions shall have effect for those purposes, that is to say:—

(a) the period of absence shall be regarded as not breaking the continuity of his service with the corporation, and

(b) notwithstanding the provisions of the foregoing paragraph, the length of the period of absence shall not be taken into account in reckoning the length of his service with the corporation nor, where an allowance for life or a gratuity is granted to him, in reckoning the amount thereof.

Short title.

3. —This Act may be cited as the Local Officers and Servants (Dublin) Act, 1941.
